On February 15, 2022, City Council authorized the Director of Community Development (Zoning Administrator) to approve minor impact variances for properties damaged and destroyed by the Marshall Fire to facilitate reconstruction of homes.  This authority allows variances up to 10% from a published standard.  For example, up to 1' into a 10' Rear Setback, or up to 33% Maximum Lot Coverage where 30% is permitted.  

Complete the form below to apply for a Recovery Variance.  Within the attachment fields, please provide a complete site plan, architectural elevations and any other information to illustrate the request.  Proof of ownership is required.  If you need assistance locating Proof of Ownership, contact Planning for a copy.

  • All applications require submission of a Site Plan clearly showing property lines, the proposed structure, minimum zoning setbacks, and dimensions from the structure to property lines
  • For variances related to height, provide architectural elevations showing building design and proposed height along with a survey showing topographic data
